Appeal by the government from judgments entered against Lloyd Bryson and Rodney Joseph in the United States District Court for the Eastern District of New York (Jack Weinstein, District Judge) convicting Bryson and Joseph upon pleas of guilty for conspiring to commit a narcotics offense, in violation of 21 U.S.C. § 846, and departing downward from the Sentencing Guidelines to sentence both defendants to a 60 month term of imprisonment. We vacate and remand for the sentencing court to resentence Bryson in accordance with the Sentencing Guidelines. As to Joseph, we remand for further development of the record concerning Josephs "extraordinary" rehabilitation that may warrant downward departure; if such rehabilitation cannot be shown, Joseph is to be resentenced according to the Guidelines.
